TRANSFER OF PROPERTY

The Transfer of Property Act was passed in the year 1882 as an Indian legislation which regulates the transfer of property in India. It contains specific provisions regarding what constitutes a transfer and the conditions attached to it. The Act defines - "transfer of property" as an act by which a living person conveys property, in present or in future, to one or more other living.

WILLS, TRUST & ESTATE PLANNING

Estate planning is the pre-agreement of tasks that serve to manage an individual's assets in the event of their incapacitation or death. The planning includes the bequest of assets to heirs and the settlement of estate taxes. The most common manner by which estates planning takes place is through Wills and Trusts.

RERA

The Real Estate (Regulation and Development) Act was established in the year 2016, an Indian legislation which seeks to protect potential Home/Apartment/Flat purchasers. It acts as an adjudicating body for speedy dispute resolution between parties. The Act establishes a (RERA) in each state for regulation of the real estate sector.

CONTRACT LAW

The Indian Contract Act, 1872 defines the term "Contract" under its section 2 (h) as "An agreement enforceable by law". A contract is broadly defined as agreement made for a lawful object, between two or more parties who are major in age and competent, for consideration with their free consent.

SUCCESSION LAWS IN INDIA

Law of succession is one of the few laws in India, that is governed by its personal laws. There are three laws mainly governing inheritance and succession " The Indian Succession Act 1925, the Hindu Succession Act (amendment.) 2005 and Mohammedan laws of inheritance. The scope of the these laws are to lay down the process of inheritance of movable and immovable assets, when a person dies intestate.

REGISTRATION ACT 1908

The object of Act was to consolidate provisions relating to the registration of Title Agreements, Deeds and other Documents. Section 17 of the Act throws light on the nature of documents that need to be compulsorily registered under the law.
